I did not even have to read this bill to pick out three parts of it that are unconstitutional. Maybe someone else out there has read parts of the bill and can think of others that I have missed.
Of course, no where in the constitution is the federal government granted the authority to force the American people to purchase anything. This bill forces all citizens to purchase health coverage and establishes a brand new entitlement program to help them afford it with American taxpayer dollars. Liberals in the Congress and in the media will argue that we already have to purchase car insurance, but that is just not true. You only need to purchase car insurance if you choose to own and/or operate a motor vehicle. There are plenty of people that choose not to drive or simply cannot afford to, so they take public transportation. With this legislation, there is no such choice to opt out. You cannot simply say, “I will not purchase health coverage because I will not use American doctors and hospitals.”
It is also unconstitutional to use different federal tax rules on different states. Do you think that smaller states with unequal representation in the House of Representatives would have ever signed the Constitution if states with larger populations (and more representatives) could vote for more favorable federal tax laws for their States? Ben Nelson’s little back room deal ensured that Nebraska would be taxed differently for the Medicaid expansion that will likely bankrupt most States across the country or force them to raise taxes. It is unconstitutional, and it proves that Ben Nelson realized that this bill was bad for the States.
This bill also limits what insurance company executives can be paid in salary and bonuses. Most of these companies never received or asked for any federal bailout money. Go back and read what I wrote about limiting executive pay, even on the companies that never should have received bailout money but did anyway. Once you start going down that slippery slope the power hungry politician will seize more and more power. I do not remember the part of the constitution that granted the federal government the authority to set wages for private citizens, rich or poor.
I am sure there are other parts of the bill that are unconstitutional and it has not even been finalized. Just wait and see what other payoffs and back room deals start happening to keep this whole thing together. Keep your powder dry patriots, we are under assault.

I would have been hopeful that the courts would strike this down almost immediately but I fear they too have been physically threatened by Obama. Let's face facts folks. We are winding down to civil war. We are being given few options; I like so many of you will not be microchipped to "save money". Or forceably injected with God knows what because it's "preventative". Or have my drinking water sterilized. Or have my doctor told I don't get the necessary medication. Or get taxed 40% more for having the guts to work my whole life to afford decent health insurance. I simply won't pay any more for what I am getting. And I won't accede to any more government demands. It is time to start a secessionist movement among various states. If the insane people in Washington think they can force us like cattle to obey, then they will have to face the real America. We are not an angry mob. We are not Nazis or terrorists or any of the things they've called us on the air and from the pulpit at the White House. THE WHITE HOUSE! DID you ever think you would live to see a day when the President's Press secretary marginalizes and calls honest, hard working business owners, homemakers, grandmothers and military service personnel terrorists? You know. There's an old saying about getting what you ask for. They have categorized us as evil intent on destroying them. i hate to say it, but I have not met anyone in months who supports this stupidity in Washington. And I have met a lot of people who are moving along the sliding scale calling for secession, civil war, and looking for other ideas, than just voting out the liberal lunatics. I have not heard one good thing about this administration. This latest debacle in Denmark just puts a capstone on the grave. This supposed leader is completely ineffective, and has made this nation a laughing stock worldwide. He has actively sought to destroy our commerce, innovation, and ability to function. He has broken up families and foreclosures continue at an accelerated rate. He has incited anger, fighting and passionate protest. He has called out those Americans around him who are patriots and labeled them demonic. Unnoticed by the general public was a little known law being passed in Congress. Last week the house approved a provision to quietly alter a single codicile of the capital gains law. Not a big deal most would say. A very big deal. The biggest deal of all. They voted to shift the tax rate on the gains from venture capital investing in high tech and other future firms from 15% to ordinary expenditures of 40%. Why should you care? Obama just destroyed any chance of a jobs recovery by doing so. Here's why: Venture capital takes enormous risks. If even 1 in 5 ventures succeeds they at this point have to recover all the costs of the first four failures plus make enough on the fifth investment to pay the taxes, recover all costs and have funds left over for future investments, not to mention earn a profit. Here is what happened: Now venture capitalists must find that one investment that will recover all four bad investments and the NEW TRIPLE tax. if you invest one million dollars ( a small amount for a startup company) and you do this five times, you spend five million dollars. if four go bad, you have to get five million from the fifth PLUS the 15% above the initial investment returned just to break even. with the new law you have to get 40%. This makes it so firms won't invest in a firm one in five times, but more like one in fifteen. so the rate of investment in innovation will decline substantially. No new firms will open unless they are sure to make very high profits very quickly for recovering investment. That means fewer startups, fewer new products/services and a ripple effect of fewer suppliers, vendors and other items used to support the businesses being formed. WORSE is that in America most jobs are created by small business. we all know that. but here's what you may not have realized. when a recession ends and recovery begins, where do the most jobs get created? good paying ones? Not in the average small business. they hire incrementally, only increasing staff as needed to meet new demand for new inventories etc. The real concentration of job creation, probably over 70%, occurs across all categories of skilled/unskilled, blue and white collar, accounting, legal, all professional support, manufacturing jobs, etc. etc.etc. in those NEW STARTUPS which hire in blocks of people. From shipping clerks, and transportation, phone reception, maintenance, factory floor, engineers, designers, administration, you name it. Everything needed to run a company gets created within a few weeks! Not months or years. Obama has just nailed the coffin shut for job creation outside of government jobs. The startups I help often create higher paying attractive jobs in great environments, with high comraderie and a wonderful outlook. A new venture, new funding, new jobs, everyone pulling together to create a great firm! Now, it stops. Today there will be no recovery so don't hold your breath. No investor in the US will invest in a US company when they have NO chance of getting their money back. That money will also go OVERSEAS, to accelerate this nation's decline. We are coming close to the end folks. it is now or never. What will happen next is up to the people. The patriots. You know, the terrorists that we are. Merry Christmas and may God find the hearts of those subverting our nation and change them miraculously tonight. | |

Apparently when I posted recently about the death of entrepreneurialism and the attendant job creation I thought we might have a few months before the rug was pulled out from under the nation by Obama. Today, the Wall street Journal echoed everything i said about venture capital investment and noted that startups either can't be established due to regulation, taxes and lack of personal wealth (i.e. losses due to "stimuli" and the created mortgage crisis [created by Obama long before he took office]) AND low and behold - venture capital drying up, either hard to get or non-existent. i told you so, and I do not enjoy being right. The bulk of recovery jobs that could have been created, like the dozen or so $50,000 a year plus jobs I was on track to create for other companies are GONE. DEAD. DONE. Don't expect the market to improve soon. It won't happen. There is NO incentive for anyone to invest in American companies now. congratulations President moron. you've killed the American dream. good work. And it only took a year. All is not completely lost, but it will now take YEARS to climb out and experience true organic growth in the economy. And we will need a whole new administration to slash and burn the helpful laws these liberal theorists have put in place to destroy us. | |
